Having said that I must add that, on a personal level, I feel that it is the wrong kind of precedent to set.

IXPs are, in more ways than one, similar to Interconnect points between Telcos. These Interconnect points don't need licenses themselves, it is implied by the fact that the operators themselves are licensed. What does happen is that the regulator makes broad suggestions as to how they would desire the interconnection to happen, then the operators inform the regulator about the interconnection agreement and terms of interconnection.

If it is at all possible Uganda should take that kind of step and make a good example for the rest of the continent. Set the right kind of precedent.

What happened in Kenya was an unfortunate series of events arising out of a fundamental misunderstanding of what an IXP really is and does. Once the picture was clear, things had gone too far, and the licensing approach seemed to be the only way to get things moving without (too much) loss of face.


So, please Uganda, try and set the record straight and get your regulator (who seems to be quite "switched on") to do the right thing and let the ISPs self-regulate with UCC as a 'big brother' overseeing their behaviour.
